Possible DWI charges for UTV crash that injured Wichita man

A Wichita man was injured in a UTV crash near Shell Knob over the weekend in a suspected DWI incident. The man was a passenger when the UTV overturned off the roadway, according to the Missouri State Highway Patrol crash report. A separate report indicates Troopers requested DWI charges against the driver.
Brandon M. Herzberg, 47, of Wichita, was driving a 2017 Polaris Ranger UTV southbound on County Line Road in Shell Knob when the vehicle overturned off the roadway around 2:25 a.m. A passenger in the vehicle, Michael S. Friesen, 46, also of Wichita, suffered moderate injuries in the crash.
Friesen was transported by ambulance to Mercy Hospital in Springfield for his injuries. Herzberg had no reported injuries at the time of the crash.
Neither men were wearing safety devices at the time of the crash. Central Crossing Fire chief Rusty Rickard confirmed there were two other people in the UTV at the time of the crash who had no reported injuries at the time.
The Ranger had no reported damage from the crash.
The Missouri State Highway Patrol arrest report details Herzberg was taken into custody at 3:20 a.m. on a 12 hour hold for misdemeanor DWI and careless and imprudent driving. As of time of press, no formal charges have been filed by the Barry County prosecuting attorney.
