Sex offender found guilty by jury, sentenced to three years

A homeless man from Cassville was found guilty of rape in the second degree and sodomy in the second degree. The same jury recommended three years incarceration with the Department of Corrections on the rape charge and one year incarceration in the jail for the sodomy charge. Matthew O’Leary, 31, will have a formal sentencing hearing in front of Judge Alan Blankenship on February 26, 2018.
According to the affidavits of probable cause by the Barry County Sheriff’s Department Detective Robert Evenson, O’Leary forcibly raped and sodomized a victim on Private Road 1120 in Cassville on August 18, 2015. The report states that O’Leary used force to the sexual acts on the victim and she was unable to get away. Officers reported the victim tried to get away from him or stop him from doing the acts to her.
The jury trial began on December 6 and the jury returned their verdict of guilty on December 7. O’Leary is being held in the Barry County Jail until his sentencing hearing.
O’Leary is also awaiting trial on separate charges after he was arrested for the rape. On March 27, 2017, officers reported that O’Leary possessed a metal object that had been sharpened on the edges and could be used as a weapon as well as a baggie of amphetamine. O’Leary was charged with possession of a weapon in a county jail and possession of a controlled substance in a county jail.
Then, on May 11, 2017, officers reported that O’Leary manipulated the lock on his cell to exit his cell without permission. O’Leary was seen by officers walking around the pod area and refused to go back into his cell. O’Leary was charged with escape/attempted escape from confinement for that incident.
O’Leary is slated to have a jury trial on those three charges on March 14, 2018, in the courtroom of Judge Jack Goodman.
