Cassville man held in jail on rape charge

A Cassville man was arrested last week on a rape charge after allegedly sexually assaulting his estranged wife. Matthew O’Leary, 29, of Cassville, is charged with felony rape in the first degree and is currently being held in the Barry County Jail in lieu of a $30,000 cash-only bond.
According to the affidavit of probable cause by Barry County Sheriff’s Detective Robert Evenson, O’Leary saw his estranged wife at Fastrip in Cassville on November 17 around 1:15 p.m. The two argued in the parking lot before O’Leary took her cell phone and drove off, according to the report.
O’Leary stopped his truck on Farm Road 2172, around one mile west of Highway 37, and the victim tried to get her cell phone back. At that point, he allegedly raped her on the seat in his truck before she escaped to her car. According to Evenson’s report, the victim said “no” multiple times.
O’Leary then punched the windshield of her car, causing damage to the glass and hood. O’Leary was arrested on the warrant on Thursday, November 19, on a warrant issued by Barry County Judge Robert Foulke. The Sheriff’s Department is awaiting the results of a rape test, which will be submitted as evidence.
