A registered sex offender from Exeter is charged with sodomy after an alleged sexual assault on a victim in July. According to affidavits of probable cause, the victim was underage and staying with the suspect temporarily to work.
Jody Frank Miller, 54, of Exeter, is charged with sodomy in the first degree and was booked into the Barry County Jail for the charges on October 6.
According to affidavits of probable cause by detective Angela Cole with the Barry County Sheriff's Department, the incident happened sometime between July 10 and July 11 at Miller's residence on Farm Road 2190 in Exeter. Miller allegedly had the victim, who was under the age of 18, in his home because the victim was staying at the residence to make money in the hay field.
According to the victim, Miller provided alcohol and, after the victim fell asleep, he sodomized him. The victim reported waking up with his pajama pants and underwear pulled down as Miller was committing the assault. The victim reported being too afraid to move because of Miller's tendency to violence.
The affidavits of probable cause state that Miller had three prior convictions for statutory sodomy in the second degree from 2006 on a 14 year old male. Miller is required to register as a sex offender.
Miller is currently being held in the Barry County Jail in lieu of a $30,000 cash-only bond.
